Terms of Service

1. Acceptance of Terms

By accessing or using HomeVelza (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms you must not use the Service. We may update these Terms from time to time; continued use of the Service after an update constitutes acceptance of the revised Terms.

2. Description of Service

HomeVelza is an AI-powered interior design tool that allows registered users to upload photos of their rooms and receive AI-generated redesign suggestions. The Service is offered in two tiers:

Free tier — limited number of AI design generations per month.
PRO subscription — expanded monthly generation quota, access to premium styles, and priority processing, billed through PayPal.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use HomeVelza you must create an account using a valid email address or an authorised OAuth provider (such as Google or GitHub). You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must be at least 16 years old to register. You agree to provide accurate, current, and complete information and to update it as necessary.

4. PRO Subscription

PRO subscriptions are processed exclusively through PayPal. By subscribing you authorise PayPal to charge your selected payment method on a recurring monthly basis until you cancel.

Free trial — new subscribers receive a 3-day free trial. No charge is made during the trial period. If you do not cancel before the trial ends your subscription will automatically convert to a paid monthly plan.
Monthly billing — after the trial, your payment method will be charged at the then-current PRO rate on the same date each month.
Cancellation — you may cancel your subscription at any time via your account settings or through PayPal. Cancellation takes effect at the end of the current billing period; you retain PRO access until then.
Refunds — we do not provide refunds for partial billing periods except where required by applicable law.

5. Acceptable Use

You agree not to use the Service to:

Upload or generate content that is illegal, obscene, defamatory, threatening, or otherwise harmful.
Attempt to circumvent generation limits, reverse-engineer, or abuse the AI pipeline in any way.
Upload images you do not own or have the right to use.
Use automated scripts, bots, or scrapers to access the Service without our prior written consent.
Violate any applicable local, national, or international law or regulation.

Violation of these rules may result in immediate suspension or termination of your account.

6. Intellectual Property

Your content — you retain all ownership rights to the original photos you upload. By uploading images you grant HomeVelza a limited, non-exclusive licence to process those images solely for the purpose of providing the Service to you.

Platform — the HomeVelza name, logo, software, interface design, and all associated intellectual property are owned by HomeVelza and its licensors. You may not copy, modify, distribute, or create derivative works based on the platform without our express written permission.

AI-generated images — redesign images generated by the AI are provided to you for personal use. Ownership and usage rights of AI outputs may be subject to the terms of the underlying AI provider (Google Gemini). HomeVelza makes no warranty that AI-generated images are free from third-party intellectual property claims.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI-GENERATED RESULTS WILL MEET YOUR EXPECTATIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMEVELZA AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE — INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Termination

You may delete your account at any time via the Settings page. We reserve the right to suspend or terminate your account immediately and without notice if we reasonably believe you have violated these Terms or if required to do so by law. Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, and 10 of these Terms survive termination.
